Acceptance by you of these terms and conditions of use binds you and your employees, officers and agents to comply with these terms and conditions of use. Without implying any licence to do so, if you pass on any information contained in this website to any other person, you should pass on these terms and conditions of use also.

These terms and conditions of use replace any other terms of use for this website published on this website to date. You acknowledge that any reference to the commission includes a reference to its employees, agents and contractors and each of their respective employees, agents and contractors.

Legislative provisions


You acknowledge that you may be subject to the provisions of the Victorian Energy Efficiency Target Act 2007 and the associated provisions for penalties and civil enforcement.  

Website information


You acknowledge that much of the data collected through the VEU Registry is provided by account holders, and that the commission cannot guarantee its accuracy, currency and completeness. The commission strives to ensure that any website Information it provides is accurate, and encourages account holders to ensure the same. However, the commission does not warrant the accuracy, currency or completeness of any of the website information, including any statements relating to the Act. You should not use or rely on the website information as a substitute for professional advice.

Availability of VEU Registry

The commission makes reasonable efforts to ensure that the VEU Registry is available for users but does not warrant that the VEU Registry will be error free or that your use of it will be error free or uninterrupted.
You acknowledge and agree that the commission will not be held liable for any failure or inability to provide continuous, error free, uninterrupted access to and use of the VEU Registry. At any time and without notice, the commission may (subject to any relevant statutory obligations) suspend the VEU Registry or its operation, or disconnect or deny your access to any part of it, including:
  1. during any technical failure, modification or maintenance involving the VEU Registry. Under these circumstances, the commission will use reasonable endeavours to procure the resumption of the VEU Registry as soon as reasonably practicable;
  2. during any internet or telecommunications connectivity problems or other circumstances beyond the commission's control; or
  3. if you fail to comply with the terms of any agreement you have with us (including these General Terms) or if you do, or allow to be done, anything which in the commission's opinion may jeopardise or hinder the operation of the VEU Registry.

Security

The commission recognises the importance of protecting your security while accessing and using the VEU Registry and will use its reasonable efforts to keep its server and transmissions to and from the server secure.
You accept the risk that unauthorised third parties may intercept, gain access to and unlawfully exploit information about you, including the fact that you have accessed the VEU Registry. The commission does not warrant the security of your information on the VEU Registry.

Viruses


The commission does not represent or warrant that this website and any other information or material contained in, downloaded or accessible from this website, is free from computer viruses or any other defect or error which may affect your software or systems. You should protect your software and systems by installing and implementing your own security and system checks.

Privacy

The commission recognises the importance of protecting your privacy. The VEU Registry privacy statement forms part of these terms and conditions.
You acknowledge that you have read and understood the VEU Registry privacy statement.

Linked third party sites

Hyperlinks and pointers to websites operated by third parties appear on the VEU Registry and are for convenience only. The commission's responsibilities to you under these terms and conditions of use only apply in relation to your use of the VEU Registry, and end as soon as you leave the site.
You acknowledge that you access linked third party sites at your own risk.

No tampering or inappropriate use

You agree to not:
  1. disrupt, modify or interfere with the VEU Registry,  or associated software, hardware and servers or their operation in any way; or
  2. impede or interfere with others use of the VEU Registry or
  3. alter or tamper with any information or material on, or associated with, the VEU Registry or its operation; or
  4. do anything which imposes a disproportionate or unnecessary load on the VEU Registry or associated infrastructure; or
  5. gain, or attempt to gain unauthorised access to secure parts of the VEU Registry.
